Terms of Service

These Terms of Service ("Terms") govern your access to and use of the website operated by Crestmont Property Management, Inc. ("Crestmont," "we," "us," or "our"), including any content, tools, forms, reports, and communications made available through it (collectively, the "Site").

By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.

1. Licensing Disclosure

Crestmont is a licensed California real estate broker. All brokerage and property management activity is conducted under the supervision of the responsible broker identified above.

2. No Agency or Brokerage Relationship

Use of the Site, submission of a form, or communication with us does not create an agency, brokerage, fiduciary, or client relationship between you and Crestmont. A brokerage or property management relationship is created only by a written agreement signed by you and an authorized representative of Crestmont.

3. Informational Purpose Only

Content on the Site, including property information, market data, rent estimates, market reports, calculators, articles, and other materials, is provided for general informational purposes only. It does not constitute legal, tax, accounting, financial, investment, insurance, or appraisal advice, and it is not a substitute for advice from a qualified professional. You should consult your own attorney, accountant, or advisor before making decisions regarding real property.

4. Property Listings and Market Information

Property listings, availability, rental rates, terms, photographs, square footage, and descriptions are subject to change or withdrawal without notice and may contain errors or omissions. Information may be obtained from third-party sources, including property owners, listing services, syndication platforms, and public records, and is not independently verified by Crestmont.

Market data, rent estimates, and analytical reports are estimates based on available data and modeling assumptions. They are not appraisals, guarantees of value or rent, or predictions of future performance. Actual results will vary.

You should independently verify all information material to your decision.

5. Fair Housing and Equal Opportunity

Crestmont is an Equal Housing Opportunity provider. All properties are offered without regard to race, color, religion, sex, gender, gender identity or expression, sexual orientation, marital status, national origin, ancestry, familial status, source of income, disability, genetic information, veteran or military status, or any other characteristic protected by federal, state, or local law.

6. Acceptable Use

You agree not to:

  • Use the Site for any unlawful purpose or in violation of these Terms
  • Submit false, misleading, or fraudulent information, including false identity or license credentials
  • Scrape, harvest, crawl, or systematically extract data or listings from the Site by automated means
  • Attempt to gain unauthorized access to the Site, accounts, systems, or networks
  • Introduce malware, viruses, or other harmful code
  • Interfere with or disrupt the operation, security, or performance of the Site
  • Reproduce, republish, distribute, or resell Site content without our prior written permission
  • Use the Site to send unsolicited commercial communications

7. Submissions and Accuracy

You are responsible for the accuracy and completeness of any information you submit through the Site, including application, inquiry, referral, and license verification information. Submitting false or incomplete information may result in denial of an application, termination of access, or other action.

8. Gated Content and Restricted Materials

Certain materials, including market reports and partner resources, are made available only to verified recipients under conditions we specify. Access may require verification of professional licensure or affiliation, and access may be limited, monitored, revoked, or expired at our discretion. Restricted materials are provided for your individual professional use and may not be redistributed, republished, resold, or shared without our prior written permission.

9. Electronic Communications and Text Messaging

By providing your contact information, you consent to receive communications from us electronically, including by email and, where you have opted in, by text message.

Text messages are limited to matters related to your inquiry, application, tenancy, property, maintenance request, transaction, or referral. We do not send promotional or marketing text messages. Message frequency varies. Message and data rates may apply. Reply STOP to opt out. Reply HELP for help. Consent is not a condition of any purchase or service.

Our handling of the information you provide is described in our Privacy Policy, which is incorporated into these Terms by reference.

10. Intellectual Property

The Site and its contents, including text, graphics, logos, photographs, reports, layouts, and software, are owned by Crestmont or its licensors and are protected by copyright, trademark, and other intellectual property laws. The Crestmont name and logo are our trademarks and may not be used without prior written permission. Third-party marks appearing on the Site are the property of their respective owners and are used with permission or as permitted by law.

11. Third-Party Links and Services

The Site may link to or integrate third-party websites, applications, and services, including listing portals, payment processors, application platforms, and partner sites. We do not control and are not responsible for their content, availability, security, or practices. Your use of those services is governed by their own terms and policies.

12. Disclaimer of Warranties

THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, CRESTMONT DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT CONTENT IS ACCURATE, COMPLETE, OR CURRENT.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CRESTMONT AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SITE SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100). NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.

This section does not apply to obligations arising under a separate written management, listing, referral, or lease agreement, which are governed by the terms of that agreement.

14. Indemnification

You agree to indemnify, defend, and hold harmless Crestmont and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or related to your use of the Site, your violation of these Terms, or your violation of any law or the rights of a third party.

15. Governing Law and Venue

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any action arising out of or relating to these Terms or the Site shall be brought exclusively in the state or federal courts located in San Diego County, California, and you consent to the personal jurisdiction of those courts.

16. Dispute Resolution

Before initiating any formal proceeding, the parties agree to attempt to resolve any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site informally and in good faith.

The party raising the dispute shall provide written notice to the other party describing the nature of the dispute, the relevant facts, and the relief sought. Notice to Crestmont shall be sent to the address listed below. The parties shall then have thirty (30) days from receipt of notice to attempt to reach a resolution through direct discussion.

If the dispute is not resolved within that period, the parties may, by mutual written agreement, submit the dispute to non-binding mediation before a mutually acceptable mediator in San Diego County, California, with the costs of mediation shared equally. Mediation is not required, and neither party is obligated to agree to it.

If the dispute is not resolved informally or through mediation, either party may pursue any remedy available at law or in equity, subject to the governing law and venue provisions in Section 15.

Nothing in this section prevents either party from seeking injunctive or other equitable relief in a court of competent jurisdiction to protect intellectual property or confidential information, or from bringing an individual claim in small claims court where jurisdictionally appropriate.

This section applies only to disputes arising out of these Terms or your use of the Site. Disputes arising under a separate written management, listing, referral, or lease agreement are governed by the dispute resolution provisions of that agreement, which control in the event of any conflict with this section.

17. Severability and Waiver

If any provision of these Terms is held unenforceable, that provision will be limited or severed to the minimum extent necessary and the remaining provisions will remain in full force. Our failure to enforce any provision is not a waiver of that provision or any other.

18. Changes to These Terms

We may modify these Terms at any time. The revised Terms will be posted on this page with an updated effective date. Your continued use of the Site after the effective date constitutes acceptance of the revised Terms.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Crestmont regarding the Site and supersede any prior understandings regarding the Site. They do not supersede any separate written agreement you have entered into with Crestmont regarding property management, brokerage, referral, or tenancy.
